Canada-Owned Business Certification – Terms and Conditions
1. Introduction By applying for and purchasing the Canadian-Owned Business Certification ("Certification"), the applicant ("Customer") agrees to comply with the terms and conditions outlined herein. These terms ensure that the Certification remains credible and reflects the standards set forth for Canadian-owned businesses.
2. Eligibility Requirements To qualify for the Certification, the Customer must meet all the following criteria:
At least 51% of the business is owned by Canadian citizens or permanent residents.
The business is legally registered in Canada.
The business is headquartered in Canada.
At least 51% of the businesses leadership/executive team are based in Canada.
3. Application and Verification Process 3.1 The Customer agrees to provide accurate and complete documentation to verify compliance with the Certification criteria. Documentation may include business registration records, shareholder agreements, employee records, and any other requested supporting materials.
3.2 The certifying body reserves the right to request additional information, conduct audits, or verify the submitted documentation at any time.
3.3 Failure to provide requested documents or any misrepresentation of information may result in denial or revocation of Certification without refund.
4. Certification Fees & Payment 4.1 The Customer agrees to pay the applicable Certification fee as outlined at the time of application.
4.2 All payments are non-refundable, regardless of the outcome of the application.
4.3 Renewal fees, if applicable, must be paid prior to the expiration of the Certification to maintain active status.
5. Certification Validity & Renewal 5.1 Certification is valid for a period of 1 year from the date of approval.
5.2 The Customer must submit updated information for review upon renewal to confirm ongoing compliance with the eligibility criteria.
6. Use of Certification & Logo 6.1 Upon approval, the Customer may display the Certification logo on business materials, websites, and marketing materials.
6.2 Misuse, unauthorized alterations, or misleading representation of the Certification may result in revocation.
7. Compliance & Audits 7.1 The certifying body reserves the right to conduct periodic compliance checks or request updated information at any time.
7.2 If a business no longer meets the eligibility requirements, the Certification may be revoked, and the Customer must immediately cease its use.
8. Revocation 8.1 Certification may be revoked if the business is found to be non-compliant with any eligibility criteria or engages in fraudulent or unethical business practices.
9. Limitation of Liability 9.1 The certifying body makes no warranties, expressed or implied, regarding the business performance, profitability, or eligibility for other programs based on Certification status.
9.2 The certifying body assumes no liability for any damages, losses, claims, or legal actions arising from the granting, denial, maintenance, or revocation of Certification. The Customer agrees to indemnify and hold harmless the certifying body, its officers, employees, and agents from any claims, liabilities, or expenses, including legal fees, related to the Certification process.
10. Modifications to Terms 10.1 The certifying body reserves the right to modify these Terms and Conditions at any time.
11. Governing Law 11.1 These Terms and Conditions shall be governed by and construed in accordance with the laws of Canada.
By proceeding with payment and application, the Customer acknowledges that they have read, understood, and agreed to these Terms and Conditions.
